 Accuracy of Information: I have provided true, accurate, and complete information in this application form, and I/my ward am solely responsible for the authenticity and correctness of this information. I understand that any false, misleading, or incomplete information may lead to disqualification from participation without any refund or liability on the part of the organizer.

Consent for Use of Personal Data: I am aware of and consent to the purposes for which my/my ward’s personal data may be collected, stored, processed, and used by the organizer, RunnerX, and any of its authorized partners, vendors, or affiliated entities, including but not limited to registration, identification, communication, emergency purposes, event logistics, promotions, and regulatory compliance.

Assumption of Risk: I fully understand the inherent and associated risks, hazards, and responsibilities of participating in the Jodhpur Marathon 2026 or any related event or activity outlined in this application (collectively, “the Event”). I acknowledge that I/my ward will be participating entirely at my/his/her own risk and sole responsibility and that the Event may involve physical exertion, fatigue, dehydration, traffic exposure, natural terrain hazards, adverse weather, medical complications, or unforeseen incidents.

Route Adherence: I understand and agree that I/my ward shall strictly participate only on the designated and approved route(s) marked by the Event organizers and shall follow all rules, signage, instructions, and directions issued by RunnerX or authorized marshals and security personnel. Any deviation from the assigned route or non-compliance with rules may result in immediate disqualification.

Fitness and Medical Clearance: I declare that I/my ward am/are in good physical and mental condition and have undertaken adequate training to prepare for the physical demands of the Event. I confirm that I/my ward have obtained and relied upon a valid medical clearance from a registered medical practitioner certifying that I/my ward am/are fit to participate in the Event. I accept full responsibility for any medical conditions that may arise during or after the Event.

Waiver of Claims: On behalf of myself/my ward and our respective heirs, successors, executors, administrators, and legal representatives, I unconditionally waive, release, and forever discharge any and all claims, demands, causes of action, losses, damages, costs, or liabilities of whatsoever nature against any and all sponsors, partners, vendors, medical service providers, government agencies, the Jodhpur Marathon organizing committee, volunteers, race officials, and the organizing entity RunnerX, including their respective directors, employees, representatives, and agents. This waiver specifically includes, but is not limited to, claims related to illness, injury, disability, property loss or damage, death, or any other loss incurred while participating in, traveling to, or returning from the Event.

Medical Data Provision: I agree to provide all requested medical information or documentation to the Event officials or medical service providers as and when requested. I understand that submission of such data does not oblige the Event or its affiliates to provide medical treatment or assume any duty of care, and that medical personnel present are voluntary or contracted providers.

Liability for Medical Conditions: In case of any illness, injury, pre-existing or undisclosed medical condition, disability, or death suffered by me/my ward at any point before, during, or after the Event, I agree and accept that neither RunnerX nor any associated individuals or entities shall be held liable. I further agree that the burden of any resulting expense, treatment, loss of income, insurance claim, or damages shall lie solely with me or my legal representatives.

Force Majeure and Disease Liability: I understand and agree that the Event organizers, including RunnerX and all other associated persons or entities, shall bear no responsibility or liability for any loss, delay, injury, illness (including contagious, infectious, transmittable, or pandemic-related diseases), or death caused by force majeure circumstances, including but not limited to natural disasters, storms, floods, earthquakes, fire, acts of God, war, terrorism, strikes, lockouts, epidemics, pandemics (including COVID-19 or its variants), government restrictions, or any unforeseen conditions beyond the control of the organizers.

Information Sharing: I irrevocably authorize and permit RunnerX and/or the Jodhpur Marathon organizers to share the information provided by me/my ward in this application form with all and any vendors, contractors, sponsors, governmental agencies, timing partners, medical providers, and other parties as may be necessary or appropriate for conducting, managing, analyzing, publicizing, or promoting the Event or similar future events.

Use of Photographs and Videos: I understand, acknowledge, and irrevocably grant permission to RunnerX, its affiliates, and media partners to use any photograph, video footage, voice recording, or other likeness of me/my ward taken during or in connection with the Event without remuneration, approval, or notice, for the purpose of marketing, reporting, publicizing, archival use, or any lawful promotional or commercial use, in perpetuity.

Promotional Communications: I agree and consent to receive communications, messages, advertisements, and promotional offers from RunnerX and/or its partners, brands, sponsors, or service providers through any medium, including SMS, email, WhatsApp, telephone, or postal mail, using the contact details I have provided in the application form.

Event Updates via WhatsApp: I consent to receiving all official communications, announcements, reminders, route maps, and Event-related updates for myself/my ward on the registered mobile number via WhatsApp and understand that opting out may affect the timely receipt of essential event information.

Acceptance of Terms and Guidelines: I hereby confirm that I have read, fully understood, and voluntarily accepted all terms, conditions, and guidelines issued by RunnerX for participation in the Jodhpur Marathon 2026, as may be updated from time to time on the official event website or through official communications.

Indemnification: I undertake to indemnify and hold harmless RunnerX, its officers, agents, employees, volunteers, and affiliates from any and all claims, losses, liabilities, legal proceedings, penalties, or expenses (including legal fees) arising out of or in connection with any breach of this declaration or the participation of myself/my ward in the Event.

Binding Agreement: I confirm that this declaration shall be binding upon me/my ward and our respective heirs, legal representatives, successors, and assigns, and shall be governed by and construed in accordance with the laws of the Republic of India. Any dispute arising from this agreement shall be subject to the exclusive jurisdiction of the competent courts of Jodhpur, Rajasthan.
